Customer Agreement & Terms of Use

This Customer Agreement ("Agreement") is a legally binding contract between you ("User", "Buyer", "Seller") and Bostrobazar, an online marketplace operated from Dhaka, Bangladesh ("we", "us", "Platform"). By creating an account or using the Platform, you agree to these Terms.

This Agreement is governed by the laws of the People's Republic of Bangladesh, in particular the Contract Act, 1872, the Sale of Goods Act, 1930, the Consumer Rights Protection Act, 2009, the Information and Communication Technology Act, 2006, the Digital Security Act, 2018, and the Bangladesh Bank guidelines on electronic payments and Mobile Financial Services.

1. Eligibility

You must be at least 18 years old and competent to contract under the Contract Act, 1872 to use the Platform. Sellers must be lawfully able to do business in Bangladesh and, where applicable, hold a valid Trade Licence, TIN and BIN.

2. Our role

Bostrobazar is an intermediary platform. The contract of sale is concluded directly between the Buyer and the Seller. Bostrobazar is not the manufacturer, importer, owner, or seller of the listed goods unless explicitly stated. We do not warrant the quality, safety, or legality of items listed by independent sellers, but we provide tools, dispute resolution, and a Buyer Protection programme to make transactions safer.

3. Account & security

  • You must provide accurate and current information when registering.
  • You are responsible for all activity under your account and for keeping your password confidential.
  • One person — one account. Multiple or fake accounts may be suspended.
  • We may require NID / passport verification for sellers under our anti-fraud and KYC policies.

4. Listings & prohibited items

Sellers may not list items prohibited under Bangladeshi law, including:

  • Narcotics, alcohol, tobacco products restricted by law.
  • Firearms, ammunition, and explosives.
  • Counterfeit, smuggled, or stolen goods.
  • Items that violate intellectual property rights or trademarks.
  • Religiously, politically, or sexually offensive material that violates the Digital Security Act, 2018.
  • Live animals, human organs, hazardous chemicals, or any item requiring a regulatory permit the Seller does not hold.

We may remove any listing and suspend any account that violates these rules at our sole discretion.

5. Pricing, payments & taxes

  • All prices are in Bangladeshi Taka (BDT, ৳) and inclusive of applicable VAT unless stated otherwise.
  • Payments are processed through licensed payment service providers (bKash, Nagad, Rocket, Upay, SSLCommerz, debit/credit cards) or cash on delivery where available.
  • Sellers are responsible for their own income tax, VAT, and any other statutory obligations under Bangladeshi law.
  • Bostrobazar may charge service fees, commissions, and payout fees, which are disclosed before you complete a transaction.

6. Delivery

Delivery is arranged through Bostrobazar's logistics partners or directly by the Seller. Estimated delivery times are indicative and may vary based on location, courier capacity, and force majeure events. Inside Dhaka delivery is typically 1–3 business days; outside Dhaka 3–7 business days.

7. Returns, refunds & Buyer Protection

  • Under the Consumer Rights Protection Act, 2009, you are entitled to receive goods that match the description and are free of defects.
  • Buyers may raise a return or refund request within 3 days of delivery for items that are damaged, fake, or materially different from the listing.
  • Pre-loved/used items are sold as described — minor wear consistent with use is not a ground for refund.
  • Refunds are issued to the original payment method within 7–14 business days after approval.
  • For COD orders, refunds are made via bKash/Nagad/Rocket or bank transfer.

8. Seller obligations

  • Provide accurate descriptions, photos, sizes, and condition labels.
  • Ship within the time advertised; otherwise the Buyer may cancel without penalty.
  • Handle returns in line with Section 7.
  • Maintain professional and respectful communication with Buyers.
  • Comply with all tax, customs, and trade licensing rules in Bangladesh.

9. Buyer obligations

  • Pay the agreed amount on time.
  • Provide an accurate delivery address and accept the parcel within reasonable attempts.
  • Treat sellers respectfully and avoid abusive language or harassment.
  • Repeated unjustified COD refusals may result in account restrictions.

10. Reviews & user content

You may post reviews, photos, and comments. You must not post content that is unlawful, defamatory, obscene, threatening, or in violation of the Digital Security Act, 2018. You grant Bostrobazar a worldwide, royalty-free, non-exclusive licence to display and promote your content on the Platform.

11. Intellectual property

The Bostrobazar name, logo, design, and software are owned by us and protected by the Copyright Act, 2000 and the Trademarks Act, 2009. You may not copy, modify, or commercially exploit any part of the Platform without our written consent.

12. Suspension & termination

We may suspend or terminate your account at any time for breach of this Agreement, fraudulent activity, or repeated complaints. You may close your account at any time by contacting support; pending orders and statutory record-keeping obligations will still apply.

13. Disclaimers & limitation of liability

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by Bangladeshi law, Bostrobazar shall not be liable for indirect, incidental, or consequential damages. Our aggregate liability for any single transaction shall not exceed the value of that transaction. Nothing in this Agreement limits any non-waivable rights you have under the Consumer Rights Protection Act, 2009.

14. Force majeure

Neither party is liable for failure to perform caused by events beyond reasonable control, including floods, cyclones, strikes, hartals, blockades, pandemics, war, or government action.

15. Dispute resolution

We encourage Users to first contact our support team to resolve disputes amicably. If a dispute cannot be resolved, it may be referred to the Directorate of National Consumer Rights Protection (DNCRP). Unresolved disputes shall finally be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh.

16. Governing law

This Agreement is governed by and construed in accordance with the laws of Bangladesh.

17. Changes to these Terms

We may amend this Agreement from time to time. Material changes will be notified through the Platform. Continued use of the Platform after the effective date of changes constitutes acceptance.
